Regulator: The Louisiana Attorney General ('AG')

Summary: The right to privacy is protected by Article 1(5) of the Louisiana Constitution of 1974 and all four common law invasion of privacy claims are recognised within the State. There is also a requirement to notify data breaches under the Database Security Breach Notification Law according to which breaches involving personal information must be communicated to the AG and to Louisiana residents whose information was breached. Failure to notify the AG may result in a fine of up to $5,000 per day. In addition, various other statutes within the State create obligations regarding, for example, unsolicited marketing and the privacy of students.
