Brazil: President promulgates provisional measure requiring Telcos to share data with IBGE

The President of the Federative Republic of Brazil, Jair Bolsonaro, promulgated, on 17 April 2020, Provisional Measure 954/2020 ('the Provisional Measure') which requires telecommunications operators ('Telcos') that provide fixed telephone services and personal mobile services to share data with the Brazilian Institute of Geography and Statistics Foundation ('IBGE') for the purpose of supporting official statistical production during a public health emergency. In particular, the Provisional Measure requires Telcos to share with IBGE in electronic form, the list of names, telephone numbers, and addresses of their consumers, individuals, or legal entities, which will be used by IBGE for statistical purposes. In addition, the Provisional Measure stipulates that the shared data will be confidential, will be used exclusively for the purpose provided, and will not be used as an object of certificate or evidence in administrative, fiscal, or judicial proceedings.
