France: CNIL publishes Conseil d'Etat decision on delisting

The French data protection authority ('CNIL') published, on 27 March 2020, the Conseil d'Etat decision ('the Decision') issued on 27 March 2020 on the right to delisting with regards to the litigation between CNIL and Google Inc. In particular, in its Decision, the Conseil d'Etat annulled the sanction of CNIL against Google, reasoning that CNIL was not entitled to order a worldwide delisting. In addition, the Decision, relying on the CJEU decision on Google v CNIL, outlined that in the absence of specific legislative provisions, CNIL only has the competence to order a European delisting rather than a worldwide delisting.
