Hong Kong: AAB dismisses appeal against PCPD decision
The Office of the Privacy Commissioner for Personal Data ('PCPD') announced, on 25 March 2020, that the Administrative Appeals Board ('AAB') dismissed an appeal regarding the PCPD's 2018 decision ('the Decision'). In particular, the Decision regards the complaint of the Legislative Commissioner, Hui Chi-fung, against government practices of recording the whereabouts of members of the Legislative Council, alleging that such action violates the Personal Data (Privacy) Ordinance 1997 as amended in 2013 ('the PDPO’), the PCPD had found that no such violation occurred under the Schedule 1 of the PDPO.
Furthermore, the AAB affirmed the PCPD's decision and the fact the government's practices do not violate the PDPO for the relevant purposes, that such collection of personal data is required when performing the duty of communications, and that retention of such data is in line with the relevant data protection principles.
