Italy: Garante issues opinion on medical prescription delivery
The Italian data protection authority ('Garante') issued, on 19 May 2020, its favourable opinion ('the Opinion') on the Ministry of Economy and Finance's ('MEF') draft ministerial decree extending the regulations on the dematerialisation of medical prescriptions to further categories of prescriptions. In addition, the Opinion addresses the means of delivery to the patient of the prescription's dematerialised memo by the health care professional, as amended by the draft ministerial decree. Moreover, the Opinion outlines that, in the case the memo is sent by email, it must be included within an attachment of the email and not in the body of the message, and that it must also be appropriately encrypted. Furthermore, the Opinion highlights that, when the memo is sent by SMS, the same must only include the reference number of the prescription, and not further information.
