Spain: AEPD fines Xfera Moviles €5,000 for GDPR violation

The Spanish data protection authority ('AEPD') issued, on 25 March 2020, a resolution ('the Resolution') in proceeding No. PS/00436/2019 fining Xfera Moviles, S.A. €5,000 for violation of Article 58(1) of the General Data Protection Regulation (Regulation (EU) (2016/679) ('GDPR'). In particular, the Resolution outlines that, following the subject access request of an individual, the AEPD has ordered Xfera Moviles to provide the requested information. In addition, the Resolution highlights that Xfera Moviles has not responded to the request within the provided deadline, and that its conduct amounted to a violation of Article 58(1) of the GDPR. As a consequence, the Resolution imposes on Xfera Moviles a fine of €5,000.
