Spain: AEPD issues blog post on consent under the GDPR

The Spanish data protection authority ('AEPD') issued, on 27 February 2020, a blog post ('the Blog Post') on consent under the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR'). In particular, the Blog Post addresses the conditions for obtaining valid consent under the GDPR. In addition, the Blog Post highlights that data subjects must receive a certain minimum level of information prior to the provision of consent, in order for them to give a valid and clearly informed decision. Moreover, the Blog Post states that data controllers must be able to demonstrate that the data subject provided consent in a valid manner.
