Spain: AEPD issues statement on health data collection and Coronavirus

The Spanish data protection authority ('AEPD') issued, on 26 March 2020, a statement ('the Statement') on the collection of special categories of personal data such as health data in relation to the COVID-19 ('Coronavirus') emergency. In particular, the AEPD recalled that the legal basis for processing personal data in the current situation is the public interest, as well as the need to protect a vital interest of affected subjects. In addition, the AEPD highlights that private organisations collaborating with public authorities may process personal data only in accordance with received instructions. Furthermore, in relation to the possibility of geolocating citizens who have tested positive through their mobile phones in order to monitor their quarantine, the AEPD states that the only data that telecommunications providers should grant to public authorities is the one corresponding to the mobile phone geolocation.
