Taiwan: MOHW issues draft implementation measures for security of personal data files in hospitals

The Ministry of Health and Welfare ('MOHW') issued, on 11 February 2020, Draft Implementation Measures of the Hospital Personal Data Archives Security Maintenance Plan ('the Draft Measures'), and is requesting comments on the same. In particular, the Draft Measures aim to strengthen hospitals' measures for the protection, security, and integrity of personal data, and establish a mechanism for the management, audit, and preservation of personal data. Moreover, the Draft Measures address, among other things, the obligations for hospitals to establish contingency mechansims, the necessary safety equipment and protective measures, the requirements that hospitals should meet when collecting and transmitting personal data, the regular deletion of personal data, and the relevant competent authority.

Comments can be submitted until 13 April 2020 via post to the Department of Medical Affairs of the MOHW, No. 488, Section 6, Zhongxiao East Road, Nangang District, Taipei City, or via email to [email protected], among other methods.
