Austria: NOYB files complaint against KS­V1870 for data subject rights violation

On January 4, 2024, none of your business (NOYB) announced that, on the same date, it had filed a complaint and report against KSV1870 (KSV), a creditors' protection association, with the Austrian data protection authority (DSB), alleging that KSV is misleading users by urging them to purchase 'InfoPass' instead of getting a free copy of their data, in violation of the General Data Protection Regulation (GDPR).

What are the grounds for the complaint?

NOYB stated that KSV's website hides the fact that data subjects have the option to request the information free of charge. Further, according to NOYB, KSV's website states that the delivery period is three days for paying customers, and for access requests according to the GDPR, a waiting period of 25 to 30 days. NOYB alleges that KSV's practice violates Article 15 of the GDPR, which requires companies to provide information to the data subjects free of cost and without undue delay.
