Baden-Württemberg: LfDI Baden-Württemberg publishes updated guidance on the adequacy decision regarding data transfers to the USA

On February 28, 2024, the Baden-Württemberg data protection authority (LfDI Baden-Württemberg) published updated guidance on Third Country Transfers under the General Data Protection Regulation (GDPR). In particular, the LfDI Baden-Württemberg highlighted that the current adequacy decision of the European Commission for the USA of July 10, 2023, allows the transfer to self-certified organizations under the Data Privacy Framework (DPF). The LfDI Baden-Württemberg notes that the guide now takes such adequacy decision into account.

The guide provides information on the legality of transfers to third countries generally, alongside information on data transfer mechanisms, including adequacy decisions and appropriate guarantees regarding contracts between data importers and data exporters.
