Brazil: Bill on copyright infringement using AI and other provisions referred to Senate Commission
On February 20, 2024, Bill No. 262/2024 amending the Penal Code to provide grounds for increasing penalties for copyright infringement when artificial intelligence (AI) is used, and to create the crime of scientific or academic falsehood was referred to the Senate Commission on Science, Technology, Innovation, and Computing.
What are the main provisions of the bill?
The bill amends the Penal Code to provide that the penalties for copyright infringement are increased from one-third to half if the violation is committed using AI.
Additionally, the bill creates the crime of scientific or academic falsehood, defined as the preparation, offer, advertising, or sale of scientific or academic work so that a third party can use it as a legitimate author. The penalties for scientific or academic falsehood are also increased from one-sixth to one-third if the crime is committed using AI.
