Cayman Islands: Ombudsman releases annual report for 2021

The Office of the Ombudsman ('the Ombudsman') released, on 7 December 2022, its annual report for 2021 presented, on the same date, to the Cayman Islands Legislative Assembly. In particular, the Ombudsman noted that the report details, among other things, that work in privacy protection and data-related complaints increased during 2021, with the receipt of 30 complaints and 101 data breach notifications, as well as 138 inquiries about data protection. Notably, the Ombudsman highlighted that it had issued five formal enforcement orders in the course of the year, and resolved 17 complaints and 96 data breaches, numbers which are all higher than in the previous year.

With regard to whistleblower protection, the Ombudsman explained that it continued to be the most underused service it provides to the public, and that it is continuing to work on amendments to the Whistleblower Protection Act, which it hopes to present to the Cayman Islands Legislative Assembly. Lastly, the Ombudsman outlined that the number of inquiries from potential whistleblowers was relatively low during 2021, and that there is a need for greater public awareness of this tool which will be its focus once changes are made to the enabling legislation.
