Costa Rica: PRODHAB publishes factsheet on data protection law

The Costa Rican data protection authority ('PRODHAB') published, on 24 September 2019, a fact sheet ('the Factsheet') for consumers and businesses on the Law on the Protection of Persons Regarding the Processing of their Personal Data No. 8968 2011. In particular, the Factsheet outlines that sensitive data is defined as any information related to the intimate sphere of a person and that using sensitive data without authorisation can lead to discrimination. The Factsheet highlights that there is a high level of unawareness in Costa Rica with regards to data protection from the part of consumers as well as businesses. Moreover, the Factsheet outlines, among other things, that businesses can be held responsible if they collect, store, transfer or process sensitive data, and that violations can result in financial sanctions of between CRC 6 million and CRC 13 million (approx. €9,400 and €20,300). Finally, the Factsheet provides information on exemptions, such as law enforcement proceedings, and on how to file a complaint in case of a data breach.
