Germany: Committees issue recommendations on draft law amending federal data protection act

On March 11, 2024, the German Federal Parliament (Bundestag) announced that the Lead Committee on Internal Affairs, Committees on Environment, Nature Conservation and Nuclear Safety, and Legal Affairs Committee issued recommendations on the draft law amending the Federal Data Protection Act of 30 June 2017 (implementing the GDPR) (as amended) (the Act).

In particular, the Committees recommended, among other things, repealing Section 38 of the Act, relating to the obligation to appoint a Data Protection Officer (DPO) under certain conditions in addition to the requirements under the General Data Protection Regulation (GDPR). The Committees also provide justifications for their recommendations.
