Guernsey: ODPA confirms to pursue legal action for failure to register

On July 29, 2023, the Office of the Data Protection Authority (ODPA) confirmed that it will pursue legal action against companies for failure to register under the Data Protection (Bailiwick of Guernsey) Law. The ODPA noted that a considerable amount of time and effort is put into responding to registration non-compliance by those who should be registered but have failed to do so. To this end, the ODPA highlighted that as a final resort, it will pursue the most serious cases of non-compliance through the Petty Debt process in the Magistrate's Court.

The ODPA reiterated that any organization (including sole traders) that handles personal information during the course of their business activities, including just names and addresses, must register.
