Honduras: Special congressional committee issues favourable opinion on Data Protection Bill

The National Congress announced, on 28 February 2018, that the special committee appointed by the President of the National Congress ('the Committee') to analyse the Data Protection Bill ('the Bill'), had issued a favourable opinion on the same. In particular, the Committee noted that with the advent of technological developments and the increasing storage of personal data, it is necessary to recognise and establish mechanisms in Honduras to adequately protect its use and handling. 

The Bill, which consists of 103 articles divided into 13 chapters, excludes from its scope of application the databases of natural persons for personal or domestic activities, and those which are created for the purposes of public security, defence, security of the State and its activities regarding the investigation and countering of crime. The Bill also includes provisions on the processing of children's data, data subject rights, the responsibilities of data controllers, data security requirements, special categories of data, data disclosures, international data transfers, sanctions and the role of the Institute of Access to Public Information and Protection of Personal Data, and database registration.

The Committee, after examining the international standards on data protection and the data protection laws of Colombia, Costa Rica, Spain, Mexico, Uruguay and the EU, recommended certain amendments to the Bill, but overall found that it proposes a framework that can be best adapted to the institutional, legal, social and economic context of Honduras.
