Indonesia: Ministry of Labor publishes competence standards for DPOs

On June 23, 2023, the Ministry of Labor of Indonesia, published, in its Decision No. 103 of 2023, the Indonesian National Work Competency Standards (SKKNI) for the information and communication category, in the field of expertise in personal data protection.

In particular, the Decision refers to Article 53(1) of the Personal Data Protection Law (PDPL) which provides for the qualifications of data protection officers (DPOs) and states that in order to measure the work competency of the DPOs, it was necessary to have a SKKNI for DPOs. More specifically, the Decision sets forth the competence related to knowledge, skills, and work attitude of DPOs in Indonesia. The Decision will be used as the basis for developing educational and training curricula, assisting in recruitment, performance appraisal, preparation of job descriptions, development of training programs, and certifications.

Additionally, the Decision provides for competency standards mapping, a list of 19 competency units for a DPO, including, among others, a personal Data Protection Impact Assessment (DPIA) unit. The Decision further provides a description of each competency unit, its competence elements, performance criteria, knowledge, skills, and work attitude.
