OneTrust DataGuidance confirmed, on 1 April 2020, with Dan Or-Hof and Ofir Shvaitzer, Founder of and Associate at Or-Hof Technology and IP law firm, respectively, that the Israeli Defense Minister, Mr. Naftali Bennett, announced on Twitter, on 30 March 2020, the establishment of a scoring system based on artifical intelligence ('AI') for COVID-19 ('Coronavirus'). In particular, Or-Hof and Shvaitzer told OneTrust DataGuidance, "According to Bennett's Twitter account, '[…] any citizen will be graded on a scale of 1 to 10 as for their probability to be infectious with Coronavirus. For example, a grade 3 will indicate that the citizen is not infectious, while a 9.5 will indicate that the citizen is probably infectious and required to take a polymerase chain reaction testing ('PCR') throat swab.' The Israeli media reports that the new scoring system will not be used for surveillance purposes, but rather to analyse data streamed from other systems, and that at least a dozen foreign governments conduct trials to the system. In further tweets, Mr. Bennett stated that that the deployment of the system awaits the approval of the Ministry of Health and the Attorney General."

Furthermore, Or-Hof and Shvaitzer highlighted, "Mass population scoring systems are known to have potential adverse effects such as discrimination and wrongful social labelling. Specifically, non-consensual government-used scoring systems should be carefully designed to mitigate potential harm to human rights. To date, there are no indications that the Israeli government has performed sufficient privacy and security by design work, presumably due to the emergency situation. A potential use of the scoring system without proper controls and oversight raises concerns."
