Ivory Coast: ARTCI reminds data controllers of communication obligations

On February 16, 2024, the Telecommunications/ICT Regulatory Authority of Côte d'Ivoire (ARTCI) released a statement reminding data controllers and personal data protection correspondents of their obligations in terms of communication of documents.

In particular, the ARTCI highlighted Article 42 of Law 2013-450 on the Protection of Personal Data (Law 2013-450) and its requirement for data controllers to draw up an annual report on behalf of the ARTCI in compliance with the provisions of Article 41 of Law 2013-450.

Furthermore, the ARTCI emphasized Article 13(2) of Order No. 511/MPTIC/CAB of November 11, 2014, where personal data protection correspondents' staff are required to produce a report on their activities to be presented to the data controller and a copy sent to the ARTCI.

Finally, the ARTCI noted that the above-mentioned reports are to be transmitted to the ARTCI no later than March 31 of the year following the past financial year, and failure to do so could mean sanctions for refusal to communicate documents to the ARTCI which are useful to its missions, in accordance with Article 45 of Law no. 2013-450.
