Liechtenstein: DSS issues guidance on profiling and automated decision-making

The Liechtensteiner data protection authority ('DSS') published, on 1 September 2021, guidance on profiling and automated decision-making pursuant to the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR'). In particular, the DSS noted that technological developments today makes it increasingly possible to collect, process, combine and analyse large amounts of data and thus to make predictions about the behaviour, interests or characteristics of groups as well as of individual natural persons and that such profiling often serves as the basis for decisions, be it for insurance contracts, a loan or for marketing measures and much more. In addition, the guidance contains sections on the GDPR's definition of profiling with examples, general requirements for profiling according to the GDPR and additional requirements for certain automated individual decision making (based on profiling) in accordance with Article 22 of the GDPR.
