Monaco: CCIN publishes recommendation on cookie deposit and shelf-life
The Monegasque data protection authority ('CCIN') published, on 15 May 2019, its recommendation on the deposit and shelf-life of cookies and other tracers ('the Recommendation'). In particular, the CCIN outlines that informed consent is required for cookies that are not strictly necessary under Article 14(2) of Act No. 1.165 on the Protection of Personal Data (23 December 1993), and stipulates that cookie banners should offer deactivation of cookie deposits alongside information on the types of cookies used. Moreover, the CCIN urges that cookies should be kept on users' terminal equipment for as short a period as possible, and no longer than 13 months. Furthermore, the CCIN highlights that Monaco is not covered by the EU-US Privacy Shield and that informed consent must be obtained before information is transferred to companies that may be located in a country without an adequate level of protection.
