New York: Bill providing for private right of action on deepfakes referred to Committee

On January 3, 2024, Assembly Bill 4217 for an act to amend the Penal Law, in relation to establishing the crime of aggravated harassment by means of electronic or digital communications; and to amend the civil rights law, in relation to providing for a private right of action for the unlawful dissemination or publication of deep fakes, was reintroduced and referred to the Science and Technology Committee.

In particular, the bill defines 'deep fakes' as a digitized image that has been altered to include a person's face or their identifiable body part in the image, and such image is any printed material, advertisement, movie, video, communication, or computer image that depicts a pornographic or lewd sex act, as defined pursuant to the Penal Code, or graphic violence, that is published without the explicit written permission of the individual or individuals depicted, and for no other legitimate purpose other than to harass, annoy, threaten, or alarm another person.
