Newfoundland and Labrador: OIPC releases guidance on social media posting

The Office of the Information and Privacy Commissioner of Newfoundland and Labrador ('OIPC') released, on 11 September 2017, guidance on the use of social media ('the Guidance') in order to aid health custodians in complying with the Personal Health Information Act 2011 ('PHIA'). In particular, the OIPC recommended that custodians place limits on the persons authorised to post on social media and that such posting is adequately authorised, that the organisations have a written policy in place surrounding the use of social media, and that personal health information generally never be collected through or disclosed on social media.

Additionally, the Guidance outlines several steps health custodians should take to comply with PHIA, including to complete a Privacy Impact Assessment; include in a collection, use or disclosure notice the social media platforms used by the health custodian; and ensure adequate data security for social media accounts.
