Norway: Nkom requests comments on regulatory proposal amending EEA requirements for radio equipment

On January 15, 2024, the Norwegian Communications Authority (Nkom) announced that it had submitted a proposal to amend the Radio Equipment Directive due to proposed changes introduced by EU Regulation 2022/30/EU and EU Regulation 2023/2444/EU. The Nkom highlighted that they are seeking comments on the submitted proposal.

Scope of the proposal

The proposal aims to introduce requirements relating to the design, development, and production of radio equipment and would include internet-connected radio equipment. Internet-connected radio equipment is defined as radio equipment that can communicate itself over the internet, whether it communicates directly or via other equipment.

Nkom mentions that the proposal covers, but is not limited to:

  • smartwatches;
  • robot vacuum cleaners;
  • baby monitors;
  • smart home systems;
  • smart plugs;
  • connected toys (e.g., remote control-operated cars);
  • smoke detectors; and
  • garage door openers.

Among other requirements, the proposal seeks to introduce a requirement for those who design, develop, and produce internet-connected equipment that is capable of processing personal data, traffic data, or location data to incorporate security measures to ensure that user's personal data is protected.
