Shanxi: Provincial Social Credit Regulations come into force

The Standing Committee of the Shanxi Provincial People's Congress announced, on 28 February 2022, that the Shanxi Provincial Social Credit Regulations would be in force from 1 March 2022. In particular, the Standing Committee highlighted that the Regulations provide for, among other things, the construction of a social credit system, the management and use of credit information, and the protection of the rights and interests of credit subjects. More specifically, the Standing Committee stated that the Regulations confirm social credit information to be objective data and materials that can be used to identify, analyse, and judge the credit status of credit entities, including public credit information and non-public credit information.

In addition, the Standing Committee noted that the Regulations provide for the right to privacy with regard to the collection, storage, use, processing, transmission, provision, disclosure, and deletion of social credit information. Furthermore, the Standing Committee detailed that under the Regulations, when using and processing credit information and/or providing credit services, agencies must follow the principles of legality, objectivity, impartiality, prudence, and safety and conform to industry norms.
