Slovakia: ÚOOÚ announces rules for providing written consultations in field of personal data protection

On November 9, 2023, the Office for the Protection of Personal Data for the Slovak Republic (ÚOOÚ) announced a set of comprehensive rules governing the provision of written consultations in the realm of personal data protection. In particular, the ÚOOÚ has noted that it will not provide a response to:

  • requests seeking identification and determination of the legal basis of the controller;
  • requests seeking to evaluate legal analyses and conclusions. It also does not set processes for the controller or processor or prejudge the compliance of the intended course of action, as it could be the subject of future administrative or judicial proceedings. The ÚOOÚ does not express an opinion in response to the request on whether there has been a violation of legal regulations on the protection of personal data;
  • requests on disputes arising from contractual or pre-contractual relationships between the controller or processor and the data subject or other individuals are not within the scope of supervision of personal data protection;
  • requests seeking interpretation of special laws (e.g., Act No. 211/2000 Coll. on Free Access to Information and the Amendment of Certain Acts, Act No. 182/1993 Coll. on the Ownership of Flats and Non-Residential Premises as amended by later regulations). The ÚOOÚ recommends contacting the relevant legal authorities for interpretation of individual provisions of special laws;
  • offensive content;
  • notifications sent to the ÚOOÚ for information purposes, i.e. in copy (when the ÚOOÚ is the recipient of an email only in the form of a copy, CC, or blind copy, BCC); and
  • messages in a language other than Slovak, Czech, or English.
