Spain: AEPD fines Cafetería Nagasaki €1,500 for illegal positioning of CCTV cameras
The Spanish data protection authority ('AEPD') issued, on 4 February 2020, a resolution ('the Resolution') in proceeding No. PS/00427/2018 fining Cafetería Nagasaki €1,500 for violating Article 5(1)(c) of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR'). In particular, the AEPD held that Cafetería Nagasaki did not comply with its obligations under the GDPR as it positioned its CCTV cameras in such a manner that it surveilled the public space outside of its property, which disproportionally affected pedestrians. In addition, the AEPD found that Cafetería Nagasaki had acted without due diligence.
