Regulator: The Idaho Attorney General ('AG')

Summary: Whilst there is no comprehensive privacy law in Idaho, the State courts recognise all four common law invasion of privacy claims. In addition, under §28-51-104 et seq. of the Idaho Statutes, there is a requirement to notify affected consumers as well as the AG regarding personal data breaches involving unauthorised access to unencrypted computerised records to, with intentional failure to notify subject to penalties. The AG holds the power to sanction violations of the law and issue penalties. Other applicable statutes in Idaho statutes prohibit identity theft and electronic surveillance.
