Montserrat

Summary

Law: General Data Protection Regulation (Regulation 2016/679) ('GDPR')

Regulator: Not applicable.

Summary: Montserrat does not have its own general data protection law. However, Montserrat is a British Overseas Territories and the GDPR applies to Montserrat through its current applicability to the United Kingdom. Government bodies in Montserrat, such as the Communications Ministry, have encouraged compliance with the GDPR. In addition, the right to privacy is protected through the island's Constitution as a fundamental right. Montserrat is also a member state to the Caribbean Financial Action Task Force ('CFATF'), the Caribbean Community ('CARICOM') which provides information on consumer protection matters, and the inter-governmental Organisation of Eastern Caribbean States ('OECS'). The OECS, in harmonising and encouraging the adoption of common policies, also provides and assists its members in, among other things, legislative matters by providing example laws such as a Data Protection Bill, or Electronic Crimes Bill, through the E-Government for Regional Integration Project.
