Andorra: APDA publishes decree amending provision relating to the digital will

The Andorran Data Protection Authority ('APDA') published, on 1 February 2023, the Decree 45/2023 of 25 January 2023, which modifies the provisions relating to the digital will under Law 29/2021, of 28 October, of Personal Data Protection. In particular, the Decree provides, among other things, that the right to a digital will includes the option to expressly prohibit access to content, in whole or in part, to certain persons expressly indicated by the deceased, without prohibiting the right of heirs to access content that may be part of the legacy. Moreover, the Decree eliminates the Electronic Register of Digital Wills and establishes that the digital will can only be made by means of a will, codicil, or testamentary memoranda.
