California: Bill on age verification read for second time and amended

On April 18, 2024, Assembly Bill 3080 relating to age verification: obscene and indecent material was read for a second time and amended to be the Parent's Accountability and Child Protection Act.

The bill's amendments now include reasonable steps that a person or business that conducts business in California and seeks to make available products that are illegal to make available to minors can take to ensure that a purchaser is of legal age at the time of purchase or delivery. These reasonable steps include, but are not limited to:

  • requiring the user to input, scan, provide, or display a government-issued identification;
  • requiring the user to use a non-prepaid credit card or debit card for online access; or
  • implementing a system that enables only individuals with accounts designated as adult accounts to access the internet website.

The bill's amendments also provide that 'pornographic internet websites' are considered products that are illegal to make available to minors.
