Fiji: Government issues draft cybercrime bill
The Fijian Government issued, on 18 February 2020, the draft Cybercrime Bill 2020 ('the Draft Bill'). In particular, the Draft Bill seeks to align itself with the requirements under the Budapest Convention on Cybercrime, and introduces provisions on the confidentiality, integrity, and availability of computer data and computer systems, as well as offences for the unauthorised access to and interception of computer systems or data. Moreover, the Draft Bill outlines that when issuing warrants for the real time collection of traffic data and interception of content data, the judge must be satisfied that measures to maintain the privacy of others, customers, and third parties are taken.
Furthermore, the Draft Bill states that a judge may order a service provider offering its services in Fiji to submit subscriber information relating to such services in that service provider's possession or control, upon application made by a police officer or other authorised person.
