Georgia: Bill for the Georgia Data Privacy Act introduced to House of Representatives

House Bill 798 for the Georgia Data Privacy Act was filed, on 20 March 2023, with the Georgia House of Representatives. Notably, the bill was read for the first time, on 21 March 2023, and was thereafter read for a second time on 23 March 2023.

In particular, the bill stipulates that a manufacturer of consumer electronic devices that offers consumers the ability to opt out of data collection or usage of such data by third-party software developers shall not collect or use any consumer data for the same purposes for which the third-party software developer intended to collect or use such data. However, the bill clarifies that the manufacturer may also offer the consumer the ability to opt out of the collection or use of such data by the manufacturer for such purpose.

Lastly, the bill would come into effect on 1 July 2023.
