Guernsey: ODPA issues guidance on registration for sole traders and small businesses

On January 10, 2024, the Office of the Data Protection Authority (ODPA) published guidance on registration with the ODPA for sole traders and small businesses to help them understand their responsibilities under the Bailiwick's data protection law. In particular, the guidance provides that, since 2021, all entities including small businesses and sole traders, who process personal data and are 'Established in the Bailiwick' are required to register with the ODPA.

The guidance further specifies that entities operating within the Bailiwick, keeping records or using personal information about individuals (e.g., customers, members, suppliers, staff, and volunteers), are obligated to register with the ODPA. This includes various activities such as maintaining address books, phone contacts, and email lists, as well as using personal data in the course of business operations.

The ODPA has opened the annual registration window, urging organizations to review and renew their registrations by the end of February 2024.
