Italy: Garante launches investigation into OpenAI's Sora

On March 8, 2024, the Italian data protection authority (Garante) announced that it launched an investigation into a new artificial intelligence (AI) model from OpenAI OpCo, LLC.  The Garante stated that OpenAI's new AI model, Sora, can create realistic and imaginative scenes from short text instructions. The Garante highlighted that an investigation is necessary given the potential implications that the Sora service could have on the processing of users' personal data in the EU and, in particular, in Italy.  

The Garante has given OpenAI 20 days to answer clarifying questions about the AI model including: 

  • how Sora is trained;  

  • what data is processed and collected to train Sora; 

  • if categories of sensitive personal data are collected; and 

  • what sources are used to collect the data. 

The Garante also mentioned that it has requested clarification on whether the service will be offered in the EU and if so, what methods will be used to inform users and non-users about the data processing and legal bases for processing to comply with relevant EU regulations.
