Massachusetts: CCIA requests update on Massachusetts health privacy bill
On June 26, 2023, the Computer & Communications Industry Association (CCIA) submitted written comments on two bills, including the Bill on Consumer Health Data. In particular, the CCIA raised concerns about several of the broad definitions utilized in the bills, such as 'biometric data' and 'consumer health data', arguing that this could ultimately encompass consumer actions far beyond the intended scope, likely leading to consent fatigue. Furthermore, the CCIA also recommended providing an option to extend consumer requests by 45 days in certain circumstances and adding a cure period of 30 days to allow operators acting in good faith to correct unknowing and technical violations.
CCIA also asked for sufficient time for businesses to comply with proposed regulations and urged the legislature to place sole enforcement authority with the Attorney General's office.
