Moldova: NCPDP issues guidelines on right of access

The National Centre for the Protection of Personal Data ('NCPDP') announced, on 24 October 2022, that it had issued guidelines regarding access to information in line with data protection legislation. In particular, the NCPDP stated that it had developed this guidance in light of issues around the misuse of legal provisions in the field of personal data protection, particularly by public authorities, when justifying their refusal to provide information requested to realise the right of access to information. In this regard, the NCPDP noted that when the requests for access to information submitted concern, but are not limited to, statistical data, confirmation of the occurrence of certain events, names of enterprises/economic agents, state budget figures/expenditure, etc., i.e. data which does not lead to the identification of a personal data subject, the provisions of Law of 8 July 2011 No. 133 on Personal Data Protection ('the Law') cannot be invoked as a reason for not providing such information. As such, the NCPDP highlighted that through the guidelines it aims to assist the actors involved in the correct and consistent application of the provisions of the Law, including by ensuring a balance is struck between the legal provisions related to the rights of access to information and the protection of personal data.
