Legislative Bill ('LB') 297 for an Act to adopt the Personal Privacy Protection Act was introduced, on 11 January 2023, to the Nebraska State Legislature and thereafter referred, on 13 January 2023, to the Government, Military, and Veterans Affairs Committee. In particular, LB 297 would prohibit each public agency from the following, subject to exceptions:

• requiring any individual to provide personal information or otherwise compelling the release of personal information;
• requiring any non-profit organisation holding a certificate of exemption under Section 501(c) of the Internal Revenue Code to provide the relevant public agency with personal information or otherwise compelling the release of personal information;
• releasing, publicising, or otherwise publicly disclosing personal information in the possession of such public agency; or
• requesting or requiring a current or prospective contractor or grantee to provide such public agency with a list of non-profit organisations holding certificates of exemption under Section 501(c) of the Internal Revenue Code to which such contractor or grantee has provided financial or non-financial support.

Moreover, LB 297, if enacted, would become operative from 1 January 2024.

Committee files amendments to bill

The Government, Military, and Veterans Affairs committee of the Nebraska State Legislature filed, on 7 March 2023, amendments to the bill. In particular, the amendments propose, among other things, to define the term 'non-profit organisation' and to further specify the actions the public agencies are prohibited from undertaking.
