North Dakota: Bill for prohibiting sale of user protected data introduced in State House of Representatives

House Bill ('HB') 1330 for an Act relating to prohibiting covered entities from selling users' protected data without consent was introduced, on 13 January 2021, to the North Dakota House of Representatives Branch. In particular, the bill would prohibit the sale of protected data without the user's consent, where protected data includes, among other things, a user's location, screen name, website address, interests, professional history, friends, health conditions, internet browsing history. Moreover, the bill would require a covered entity to provide users with the opportunity to affirmatively click or select approval of the sale of their protected data, and the opportunity to opt-in to the sale of each type of protected data by individual selection, where protected data collected and sold by the covered entity must be described clearly in plain language to the user. Additionally, the bill provides for penalties for violations of its provisions, foreseeing a minimum penalty of $10,000 and $100,000 for knowing violations.

HB 1330 dies in committee stage

The North Dakota House of Representatives' Committee on Industry, Business and Labor voted, on 10 February 2021, against moving HB 1330 forward in the legislative process, thereby killing the bill.
