Nova Scotia: OIPC 2019-2020 annual report calls for privacy legislation modernisation and notes failures to implement recommendations

The Office of the Information and Privacy Commissioner of Nova Scotia ('OIPC') issued, on 15 July 2020, its 2019-2020 annual report ('the Report'). In particular, the Report reiterates calls for the modernisation of privacy legislation, and highlights consequences of previous failures to implement past recommendations to improve Nova Scotia's access and privacy laws, where such recommendations include mandating privacy breach reporting to the OIPC, or correcting the lack of privacy oversight for municipalities and the lack of authority to review privacy complaints about municipalities. In addition, the Report notes the backlog of cases before the OIPC reaching back to 2016, and criticises the resources and process which is required to better handle cases. Moreover, the Report discusses the effects that COVID-19 ('Coronavirus') has had, and highlights annual statistics for the year, such as 855 reported breaches in relation to personal health information.
