Peru: Ministry of Justice and Human Rights publishes draft regulations of law on transparency and access to public information

On June 13, 2023, the Ministry of Justice and Human Rights announced the publication for public comment of a draft for new regulations of the law on transparency and access to public information.

Highlights

The draft aims to optimize the current regulation and integrate improvements to the procedure for access to information, as a comprehensive review of current regulations is deemed necessary.

Among the novel aspects presented by the draft, there are mechanisms to make it easier for entities to deliver the information requested by citizens who exercise their right of access. In addition, the draft would facilitate the processing of requests for information on emails from former servers and former public officials, and the obligation to host information in transparency portals in an open and reusable data format. Moreover, the draft proposes improvements to optimize the current sanctioning regime.

 

The draft will be available to the public for a period of 30 days, during which interested stakeholders may provide their contributions, opinions, and suggestions via email at [email protected].
