South Africa: Regulator shares outcomes of PAIA and POPIA investigations and assessments

On March 26, 2024, the Information Regulator (the Regulator) held a press conference in which it shared the outcomes of its investigations and assessment into compliance with the Protection of Personal Information Act (POPIA) and Promotion of Access to Information Act (PAIA). The Regulator confirmed that it had received 982 POPIA complaints during the 2023/2024 financial year, and 14 responsible parties were assessed. Of the complaints, 682 complaints were resolved, and 10 assessments were completed and are ready for determination by the Regulator through the issuing of enforcement notices. Looking at the most recent enforcement notices, the Regulator discussed actions against TransUnion RSA, Dis-Chem Pharmacies Ltd, and the South African Police Service (SAPS). Furthermore, the Regulator highlighted that it is currently investigating the Independent Electoral Commission, the SAPS, and the Companies and Intellectual Property Commission for potential violations of POPIA.
