Sweden: IMY announces review of handling complaints against certificate of issue holders

On March 15, 2024, the Swedish data protection authority (IMY) announced that it is reviewing its handling of complaints against holders of certificates of issue following the Stockholm Court of Appeals decision which held that the constitutional protection for certificates of issue does not always take precedence over the General Data Protection Regulation (GDPR).

The IMY observed that in the past it had closed complaints relating to holders of certificates of issue due to the constitutional protection that holders of certificates of issue have for the publication of personal data. The IMY further stated that due to the Court of Appeal's ruling representing a change in past court practice, it will analyze the ruling's impact on how IMY handles complaints against holders of certificates of issue and may lead to the IMY initiating supervision.
