Sweden: IMY comments on government proposal regarding data storage and access to electronic communications
On October 30, 2023, the Swedish Authority for Privacy Protection (IMY) published its opinion on the government proposal SOU 2023:22 concerning data storage and access to electronic information. In particular, IMY considers the proposal an improvement over current legislation, but notes that the proposal must be balanced with fundamental rights accorded to individuals stemming from the European Convention on Human Rights (ECHR) among other things. Specifically, IMY stipulated that the storage of a large amount of electronic data cannot be permitted if it is general and undifferentiated, and for such storage to be permitted, it must be targeted, geographically for instance, and not cover practically the entire population. Likewise, IMY notes that non-discriminatory storage can be based on crime in a designated area, but that storage must be limited to what is absolutely necessary with regard to the purpose of storage and that there must be at least an indirect connection between serious crime and the persons whose data is stored.
