Taiwan: Legislative Yuan approves amendments to PDPA

The National Development Council ('NDC') announced, on 16 May 2023, that the Legislative Yuan approved amendments to the Personal Data Protection Act 2015 ('PDPA'), following the approval by the Executive Yuan. In particular, the NDC highlighted that the amendments will update Article 48 of the PDPA in regard to violations of security obligations and establish an independent supervision mechanism. In line with the above, the NDC confirmed that the Executive Yuan will establish a preparatory office for the Personal Data Protection Committee as soon as possible to promote the second phase of PDPA amendments, among other things. In the future, the NDC noted that the Personal Data Protection Committee will position itself as an independent and specialised agency and plan the overall supervision mechanism for data protection in public and non-public agencies.

Finally, the NDC stated that the Executive Yuan has adopted measures to prevent the leakage of personal data from non-government agencies, noting that the Executive Yuan continues to instruct ministries to step up administrative checks on high-risk businesses and accelerate administrative investigations into recent high-profile personal data leakage cases of public concern.
