Brazil: Bill increasing fines for LGPD violations sent to Senate Commission
On April 10, 2024, bill 1126/2024 to amend Law No. 13.709 of 2018, increase the administrative fines calculated on the revenue of a private legal entity, group, or conglomerate in Brazil, and other provisions was sent to the Commission on Communication and Digital Law. This follows the bill's introduction to the Senate on April 8, 2024.
Notably, the bill increases the maximum amount of the fine for violations of the General Personal Data Protection Law (LGPD) from 2% to 4% of the total revenue of the violating company, or up to BRL 100 million (approx. $19 million), instead of the current BRL 50 million (approx. $9 million).
Additionally, the bill also provides for material and non-material damages in data breach cases, as well as the criteria for fixating the amount of the fine.
