Argentina: AAIP initiates investigation into handling of personal data by Worldcoin Foundation

On August 8, 2023, the Argentinian data protection authority (AAIP) announced that it had initiated an investigation into the handling of personal data by the Worldcoin Foundation in Argentina, particularly into the treatment of sensitive data. Moreover, the AAIP noted that the objective of the investigation is to verify the security measures taken to protect the privacy of the users of the digital application.

The AAIP noted that the investigation will meticulously scrutinize the practices involved in collecting, storing, and utilizing personal data, specifically focusing on potential infringements on rights stipulated by Decree No. 25.326. Furthermore, the AAIP noted that the case recently gained public attention owing to the facial and iris scanning procedure of numerous individuals in exchange for financial compensation at various locations in the Autonomous City of Buenos Aires and the provinces of Buenos Aires, Córdoba, Mendoza, and Río Negro.

In addition, the AAIP highlighted that this incident motivates the necessity of modernizing the existing legal framework in Argentina. The updated Personal Data Protection Law was presented by the head of the AAIP, Beatriz Anchorena, on August 2, 2023, in a joint meeting of the Constitutional Affairs and General Legislation committees in the Honorable Chamber of Deputies of the Nation.
